1. Acceptance of Terms

By accessing or using the services provided by Zerix Host ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our services.

We reserve the right to update or modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services following such changes constitutes your acceptance of the revised Terms.

2. Description of Services

Zerix Host provides server hosting services including, but not limited to:

• Virtual Private Server (VPS) hosting
• Game server hosting
• Web hosting services
• Dedicated server hosting
• Associated technical support and management tools

We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice to affected users.

3. Account Registration

To use our services, you must create an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years of age or the age of legal majority in your jurisdiction to create an account and use our services. If you are under the required age, you must have permission from a parent or legal guardian.

4. Payment and Billing

All services are billed in accordance with the pricing plan selected at the time of purchase. Payments are due at the start of each billing cycle, and failure to make timely payments may result in service suspension or termination.

• Payments are processed through secure third-party payment processors
• You are responsible for any applicable taxes in your jurisdiction
• Price changes will be communicated at least 30 days in advance

5. Acceptable Use Policy

You agree to use our services only for lawful purposes and in accordance with these Terms. You shall not use our services to:

• Engage in any illegal activities or host illegal content
• Distribute malware, viruses, or other harmful software
• Send unsolicited emails, spam, or engage in phishing
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Host content promoting violence, harassment, or discrimination
• Conduct DDoS attacks or other disruptive network activities

Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund.

6. Service Level Agreement

We strive to maintain 99.9% uptime for all hosted services. In the event of unscheduled downtime exceeding our SLA commitment, eligible customers may receive service credits as described in our SLA documentation.

Scheduled maintenance windows will be communicated in advance and do not count toward downtime calculations.

7. Data and Backups

While we implement reasonable measures to protect your data, you are ultimately responsible for maintaining your own backups. We are not liable for any data loss resulting from hardware failure, user error, or other circumstances.

We recommend that all customers implement their own backup strategies in addition to any backup services we may offer.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Zerix Host shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, regardless of the cause of action or theory of liability.

Our total liability for any claim arising from or related to our services shall not exceed the amount you paid to us during the twelve (12) months preceding the event giving rise to the claim.

9. Termination

Either party may terminate the service agreement at any time. We reserve the right to suspend or terminate your account immediately if we believe you have violated these Terms or our Acceptable Use Policy.

Upon termination, your access to our services will cease, and we may delete your data after a reasonable retention period of 30 days, unless otherwise required by law.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation or, if necessary, through binding arbitration.
